CWB wins court case involving
U.S. wheat import tariffs
WINNIPEG, MANITOBA, CANADA -
The Canadian Wheat Board (CWB) won a
victory in trade court last week over U.S.
wheat import tariffs, the organization announced Oct. 30.
The U.S. Court of International Trade
(CIT) ruled on Oct. 20 that the U.S. Department of Commerce must return any duties
from tariffs that were unfairly applied to
imports of Canadian spring wheat between
August 2003 and February 2006.
"This ruling sets a valuable precedent for
anyone who trades into the United States, including western Canadian wheat farmers," said
CWB chair Larry Hill. "There are now clearer
rules about what happens at the end of the process when a trade dispute is settled - it gives
more meaning to our rights under NAFTA."
An anti-dumping and counterveiling duty
case launched in 2002 by the North Dakota
Wheat Commission resulted in tariffs that virtually halted Canadian spring wheat imports
into the U.S. for almost three years, the CWB
said. After the CWB appealed to a NAFTA
tribunal, the tariffs were deemed to have been
unfairly imposed and imports resumed.
The CIT concluded that the duties should
be repaid. "Because the subject imports (Canadian spring wheat) caused no injury during any time relevant to this inquiry, CWB
should owe no duties," the court said.

Cargill to acquire full
ownership of T22 grain elevator
BALCARRES, SASKATCHEWAN, CANADA - Cargill Limited announced on Nov. 1
that it and the 650 producer members of T22
Holdings Ltd. in Balcarres, Saskatchewan,
Canada have reached agreement for Cargill
to assume full ownership of the Terminal 22
joint venture grain elevator. A large majority of the approximately 650 shareholders of
T22 Holdings Ltd. had voted to accept Cargill's offer at a recent shareholder meeting.
The 10-year-old grain facility has eight fulltime employees and a 32,000-tonne storage
capacity and serves hundreds of grain producers throughout south and central Saskatchewan. In June 2006, Cargill and the operating company, called Terminal 22 (1998) Inc.,
entered into an operating and management
agreement that granted Cargill full managerial responsibilities for the facility. Leaders
of both organizations say that the acquisition
marks a natural progression of events in advancing the facility's growth.
